Terms of Use

By accessing or using TheRVMAP platform, website, mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and TheRVMAP, LLC ("TheRVMAP," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

TheRVMAP is an AI-powered RV travel planning and community platform that provides, among other features:

• Interactive trip planning and itinerary generation using artificial intelligence
• Big-rig-friendly RV park routing and recommendations
• Community features including groups, blogs, photo sharing, and travel timelines
• Travel mapping and route tracking tools
• Social networking features for the RV community

The Service is currently in pre-launch / early access phase. Features, availability, and pricing are subject to change without notice.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential and not share them with third parties
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

The Service may allow you to post, upload, share, or otherwise submit content including photos, trip logs, blog posts, reviews, and comments ("User Content"). By submitting User Content, you:

• Grant TheRVMAP a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, distribute, and display your User Content in connection with operating and improving the Service
• Represent that you own or have the necessary rights to the User Content and that it does not violate any third-party rights
• Agree not to post content that is unlawful, defamatory, harassing, obscene, or otherwise objectionable

We do not claim ownership of your User Content. You retain all rights to content you submit.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Scrape, crawl, or use automated means to collect data from the Service without our express written consent
• Transmit any viruses, malware, or other harmful code
• Interfere with or disrupt the integrity or performance of the Service
• Post spam, unsolicited commercial messages, or engage in any form of harassment
• Use the Service to collect personal information about other users without their consent

TheRVMAP uses artificial intelligence to generate trip itineraries, route suggestions, and other travel-related content. You acknowledge that:

• AI-generated content is provided for informational and planning purposes only and does not constitute professional travel, legal, or safety advice
• AI suggestions may contain inaccuracies, and you should independently verify all route information, RV park availability, and road conditions before travel
• TheRVMAP is not responsible for any damages or losses arising from reliance on AI-generated content
• Road and campground conditions change frequently; always confirm current conditions with authoritative sources

The Service may contain links to third-party websites, applications, or services (including RV parks, campgrounds, and navigation providers). These links are provided for convenience only. TheRVMAP does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party services. Your interactions with third-party services are governed by their respective terms and privacy policies.

All content, features, and functionality of the Service — including but not limited to the TheRVMAP name, logo, software, text, graphics, and data compilations — are owned by TheRVMAP, LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THERVMAP DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ROUTE, CAMPGROUND, OR TRAVEL INFORMATION PROVIDED THROUGH THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THERVMAP, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless TheRVMAP, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, conducted in Denver, Colorado. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — shall survive.
